New Developments in the Case: HGNS Counselor Challenges Baku Court of Appeal’s Decision

HGNS Counselor Law Firm continues to pursue justice in the case involving the recent controversial decisions by the Azerbaijani courts. Following the Supreme Court’s initial decision, which was widely criticized for its inconsistency, HGNS Counselor’s lawyer filed a plea against this ruling. While this appeal was still pending before the Presidium of the Supreme Court, the Baku Court of Appeal issued a new decision, ordering the Defendant to pay AZN 15,000 to the Claimant.

This decision has been met with significant concern, as it contradicts the terms agreed upon by the Claimant and Defendant. The original agreement outlined three options for the service fee:

  1. Both parties would reside in the same area where the home is located.
  2. They would swap homes – the Claimant would move into the Badamdar home, and the Defendant would take the Claimant’s home in Ahmedly district.
  3. Alternatively, the Defendant would pay the Claimant AZN 120,000.

The decision by the Baku Court of Appeal to impose a payment of AZN 15,000 is seen as an infringement on the Claimant’s rights and fails to honor the mutually agreed terms. HGNS Counselor is preparing to challenge this decision, emphasizing the need for a fair and just resolution.
